Hey folks, as the misinformation regarding CAA and NRC have gone way ahead now. I'm trying to give some information and Ideas on this matter. People have been asking Many questions on Its constitutionality and Discrimination. So I tried to explain it like this 👇
1- CAA is Undemocratic ? No, the bill was passed by all the Due process and procedures of the parliamentary democracy. Both CAA/NRC had been around for decades, even in Congress regimes. BJP had them on its ideological agenda. People gave a massive mandate for BJP in 2 continuous elections. BJP tabled and passed the bill in both houses of parliament. It is very democratic as it can get.But you can't make understand the left-liberals, they like democracy only when it works for them. Otherwise things are undemocratic.They could call it a failing of democracy, but it is not undemocratic.
2- CAA is Unconstitutional ? This can be decided only by the Supreme Court, there are conflicting opinions on the Constitutionality. A judicial review can settle all things in right place. Again depending on the Judicial decision, either side can claim that 'Constitution is an ass' (I do so regarding certain aspect),
but Constitutionality is not decided by ranting talking heads - media, students, or ballyhoos of bollywood.
3- CAA is Discriminatory when it comes with NRC? First of all, we don't have any ideas of NRC bill and further assumption to lead destroying public property is itself undemocratic and an act of Terrorism. Further, if as the critics are saying the duo of CAA and NRC is Discriminatory in nature! Yes CAA is discriminatory. But Discrimination is contextual. A State is not supposed to discriminate among its own citizens. CAA does not apply to India's own citizens, but to immigrants/refugees etc. A state should definitely discriminate between its own citizen and an alien. (Sorry we don't have a global Ummah or Communist proletariat empire)
Secondly, this is not the first discriminatory legislation in India. The Constitution itself has discriminatory articles which offer protections only to minorities.And these articles have been interpreted by Secular governments, that those protections/privileges are denied to the majority community. For example, the autonomy to run their own temples and eductional institutions.Did any of these protesters protest that discrimination ever? What explains their hypocrisy, that they want protections/privileges to the minorities in India based on their religion, but reject protection to minorities from the 3 neighbouring theocracies. 🙏
